Roundup is the most widely used herbicide in the world as a weedkiller. It is marketed to be used in lawns, gardens, parks, and playgrounds. In 2013, the first study was published that suggested that the active ingredient in glyphosate could cause cancer. And in 2015, a report from the International Agency for Research on Cancer (IARC) a division of the World Health Organization (WHO) found glyphosate to be “probably carcinogenic” and found it to cause cancer in lab tests on animals and damage to DNA in human cells. Following this 2015 report, the first Roundup product liability lawsuits were filed against Monsanto. The following April of 2016, another study was published that concluded that Roundup is associated with increased risks of skin cancer and lymphoma. In September, pharmaceutical company Bayer AG purchased Monsanto for $66 billion. The first wave of mass tort litigation in 2017 brought hundreds of individual Roundup lawsuits filed against Monsanto Bayer. In 2018 and 2019, the first two “test” cases went to trial resulting in jury verdicts of $289 million to $2 billion.
A global settlement agreement was proposed in 2020 in which $10 billion would be allocated to resolve any existing claims and a scientific panel would be created to decide the fate of all future claims. March 2021 came with the delay in approving the Roundup settlement due to the objections to the science panel. Two months later, Roundup MDL Judge rejected Bayer’s motion for approval of the controversial settlement proposal. Finally, in August 2021, Bayer sat aside $4.5 billion for any future Roundup claims and announced that glyphosate-based Roundup will be pulled from the market in the United States.
Monsanto Roundup litigation has come about due to Monsanto’s knowledge of the dangers associated with Roundup. The active ingredient in Roundup, glyphosate, has been known to cause cancer.
