Who’s Responsible? Calls for Justice After Fatal Crash Between American Airlines Flight and Military Helicopter in DC

On the evening of January 29, 2025, a tragic mid-air collision occurred near Ronald Reagan Washington National Airport (DCA) involving an American Airlines regional jet and a U.S. Army Black Hawk helicopter. The American Airlines flight, operated by PSA Airlines as Flight 5342, was a Bombardier CRJ700 en route from Wichita, Kansas, carrying 60 passengers and four crew members. The Army Black Hawk helicopter had three service members on board. It is being reported that no survivors have been found.

As reports continue to come in about how and why this awful tragedy was allowed to occur, Oliver Law Office extends its deepest condolences to the victims’ families. Federal investigations are already underway, and some rightfully expect potential lawsuits on the horizon as several already call for justice on behalf of victims of this unimaginable loss.

What We Know About AA Flight 5342

The collision happened around 8:48 p.m. as the CRJ700 was on final approach to Runway 33 at DCA. It appears that the military helicopter was completing a required annual night evaluation, and its path intersected with that of the commercial planes. Following the impact, the passenger jet crashed into the Potomac River. As of Thursday morning, recovery teams have retrieved 28 bodies from the river, with search efforts ongoing. The identities of the victims have not yet been released, and it’s currently unknown if any Ohio residents were among those on board.

In response to the incident, Defense Secretary Pete Hegseth announced a 48-hour operational pause for the 12th Aviation Battalion to review the circumstances surrounding the collision. It is said that the National Transportation Safety Board will take the lead in investigations.

Will Lawsuits Be Filed on Behalf of Victims?

Given the severity of the incident and the potential for negligence, it’s anticipated that lawsuits may be filed against the military and possibly other parties involved. This is not the first time a lawsuit has been filed following a tragic mid-air collision. In past cases involving aviation accidents—whether due to military aircraft, air traffic control errors, or negligence in flight operations—victims’ families held responsible parties accountable and received compensation for their loss.

As the families of the victims of Flight 5342 and those onboard the Army Black Hawk helicopter start the grieving process, many demand justice and accountability for the preventable loss of their loved ones. As investigations continue, more information will become available, shedding light on the causes of this devastating collision and the venues for compensation.

While we do not yet have the full list of victims or the confirmed reason for the crash, Oliver Law Office wants to extend our help and availability to any family members of the victims who wish to speak to an attorney and see what their legal options are. Again, we extend our deepest thoughts and condolences to those affected.
